1 Acceptance of Terms
By accessing and using SendPit ("Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.
2 Description of Service
SendPit is an email testing platform designed for developers to capture, test, and debug emails during development. The service provides SMTP endpoints for receiving and viewing test emails in a web interface.
3 Acceptable Use
You agree to use SendPit only for its intended purpose of email testing and development. You may not:
- • Use the service for sending production or marketing emails
- • Send emails containing malicious content, spam, or illegal material
- • Attempt to access other users' emails or accounts
- • Overload the service with excessive requests
- • Use the service for any unlawful purposes
4 Account Responsibilities
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.
5 Data and Privacy
Your use of SendPit is also governed by our Privacy Policy. By using the service, you consent to the collection and use of information as outlined in our Privacy Policy.
6 Service Availability
We strive to maintain service availability but cannot guarantee uninterrupted access. The service may be temporarily unavailable for maintenance, updates, or due to technical issues.
7 Liability Disclaimers
IMPORTANT: READ CAREFULLY - THIS SECTION LIMITS OUR LIABILITY
7.1 AS-IS SERVICE: SendPit is provided strictly on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind.
7.2 NO LIABILITY FOR DAMAGES: TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES.
7.3 MAXIMUM LIABILITY CAP: Our total aggregate liability shall not exceed $100 USD or the amount you paid us in the twelve (12) months preceding the claim, whichever is less.
7.4 NO WARRANTIES: We make no representations or warranties about the accuracy, reliability, completeness, or timeliness of the service.
8 Indemnification
8.1 USER INDEMNIFICATION: You agree to defend, indemnify, and hold harmless SendPit from any claims, damages, losses, and expenses arising from your use of the service, violation of these terms, or violation of third-party rights.
8.2 SCOPE: This indemnification obligation survives termination and is a material inducement for us to provide the service.
9 Data Disclaimers
9.1 DATA LOSS RISK: Using SendPit involves inherent risks including data loss, corruption, unauthorized access, and service interruptions. You use the service at your own risk.
9.2 NO BACKUP GUARANTEE: We do not guarantee data persistence, backup, or recovery. You are solely responsible for backing up important data.
9.3 DEVELOPMENT ONLY: SendPit is designed for development and testing purposes only. Do not use for production systems or sensitive data.
10 Termination
10.1 TERMINATION RIGHTS: We reserve the right to terminate, suspend, or restrict your account at any time, with or without notice or cause.
10.2 DATA DELETION: Upon termination, we may immediately delete all your data without liability or obligation to retain or return data.
10.3 SURVIVAL: Limitation of liability, indemnification, and disclaimer provisions survive termination.
11 Force Majeure
We are not liable for failure to perform due to circumstances beyond our reasonable control, including acts of God, natural disasters, war, terrorism, labor disputes, government actions, or third-party service disruptions.
12 Governing Law
12.1 GOVERNING LAW: These Terms are governed by the laws of [YOUR JURISDICTION], without regard to conflict of law principles.
12.2 DISPUTE RESOLUTION: Disputes shall be resolved exclusively through binding arbitration. You waive rights to jury trial or class action participation.

If any provision is held invalid or unenforceable, the remaining provisions remain in full force and effect.
14 Changes to Terms

15 Final Acknowledgment
BY USING SENDPIT, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS, INCLUDING ALL LIMITATIONS AND INDEMNIFICATION PROVISIONS. YOU UNDERSTAND YOU ARE USING THE SERVICE AT YOUR OWN RISK.
